    Agreement of Release

    AGREEMENT OF RELEASE
    TITLE OF BUSINESS: ATX MARTIAL ARTS RICHARD JOHNSON / TAEKWONDO KIDS AMY ENGLISH         8213 Brodie Lane, Suite 107, Austin, TX 78745 512-280-0899    
    I, the above-named person being eighteen or above, or the legal guardian of the above-named person who is under 18, in consideration of the services of
    ATX MARTIAL ARTS and TAEKWONDO KIDS, the rate charged for those services and the right to engage in activities of ATX MARTIAL ARTS and TAEKWONDO KIDS as a participant hereby acknowledge, agree and promise and covenant with ATX MARTIAL ARTS and TAEKWONDO KIDS, and all other persons or entities which may be connected to ATX MARTIAL ARTS and TAEKWONDO KIDS as follows:

    1. I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE ATX MARTIAL ARTS AND TAEKWONDO KIDS, their instructors, affiliates, employees and assigns, all above-named persons and instructors, affiliates, and any and all other persons or entities which are related to, arise out of or are in any way connected with participation in the ATX MARTIAL ARTS OR TAEKWONDO KIDS all for the purposes herein referred to as “Releasees,” from all liability to the named participant, or the legal guardian of the named participant, his or her personal representatives, assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands, therefore, an account of injury or illness to the person or property or resulting in the death of the named participant, whether caused by the negligence of the Releasees or otherwise while the participant is participating in any ATX MARTIAL ARTS or TAEKWONDO KIDS event whether it be active participation or mere observance.
    2. THE NAMED PARTICIPANT AND/OR THE LEGAL GUARDIAN OF THE NAMED PARTICIPANT EXPRESSLY ACKNOWLEDGES, UNDERSTANDS AND APPRECIATES THE INHERENT RISKS, BOTH KNOWN AND UNKNOWN WHICH MAY BE INVOLVED IN THE PARTICIPATION IN ATX MARTIAL ARTS AND TAEKWONDO KIDS; INCLUDING BUT NOT LIMITED TO RELEASEE’S SPONSORED EVENTS OCCURING OFF ATX MARTIAL ARTS AND TAEKWONDO KIDS PREMISES, EVENTS WHICH BY ITS NATURE INCLUDES INTENSE, STRESSFUL, AND STRENUOUS EXERCISES AND BODY CONTACT, AND EXPRESSLY CONSENTS TO CONFRONT THESE KNOWN AND UNKNOWN DANGERS AND FURTHER AGREES, UNDERSTANDS AND RECOGNIZES THAT THESE RISKS MAY RESULT IN SERIOUS INJURY OR ILLNESS INCLUDING BUT NOT LIMITED TO; BRUISES, BLOODY NOSES, BROKEN BONES, HEART ATTACKS OR OTHER CARDIOVASCULAR DISEASE, OR OTHER SERIOUS INJURY RESULTING IN DEATH AND/OR PROPERTY DAMAGE.  I further understand and acknowledge that these risks may result in personal claims against the Releasees or claims against me by other participants or other third parties, but I expressly covenant not to sue the Releasees for any damages which may result from the named participant’s participation in ATX MARTIAL ARTS OR TAEKWONDO KIDS.
    3. THE NAMED PARTICIPANT AND/OR THE LEGAL GUARDIAN OF THE NAMED PARTICIPANT HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, INCLUDING BUT NOT LIMITED TO; BRUISING, BLOODY NOSES, BROKEN BONES, HEART ATTACKS OR OTHER CARDIOVASCULAR DISEASE, OR OTHER SERIOUS INJURY RESULTING IN DEATH AND/OR PROPERTY DAMAGE DUE TO THE NEGLIGENCE OF RELEASEES OR OTHERWISE, WHILE PARTICIPATING IN ANY ATX MARTIAL ARTS OR TAEKWONDO KIDS EVENT.
    EACH OF THE NAMED PARTICIPANTS OR THE LEGAL GUARDIAN OF THE NAMED PARTICIPANT expressly acknowledges and agrees that the activities of ATX MARTIAL ARTS AND TAEKWONDO KIDS may be dangerous and involve the risk of serious injury or illness and/or death and/or property damage.  Each of the named participants and/or their legal guardian further expressly agree that the foregoing Release, Waiver, and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the laws of the state of Texas or the law of the province or state in which the event is conducted and that if any portion thereof invalid, it is agreed that the balance shall notwithstanding, continue in full legal force and affect.
    1. THE NAMED PARTICIPANT OR THE LEGAL GUARDIAN OF THE NAMED PARTICIPANT HEREBY AGREES to INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES from any loss, liability, damage or cost they may incur due to the named participant’s participation in ATX MARTIAL ARTS AND TAEKWONDO KIDS whether caused by the negligence of the Releasees or otherwise.  I further agree, promise, and covenant to hold harmless and indemnify ATX MARTIAL ARTS AND TAEKWONDO KIDS, ITS AGENTS OR EMPLOYEES AND ALL OTHER PERSONS OR ENTITIES FROM ALL DEFENSE COSTS INCLUDING ATTORNEY’S FEES OR FROM ANY OTHER COSTS incurred in connection with the claims for bodily injury or property damage which I may negligently cause to other third parties in the course of my participation in ATX MARTIAL ARTS AND TAEKWONDO KIDS.
    2. THE NAMED PARTICIPANT AND/OR THEIR LEGAL GUARDIAN HEREBY ACKNOWLEDGES RECEIPT OF THE FACILITY AND/OR ORGANIZATIONAL RULES AND AGREES TO ABIDE BY THESE RULES IN ALL ACTIVITIES SPONSORED BY ATX MARTIAL ARTS AND TAEKWONDO KIDS, THE NAMED PARTICIPANT AND/OR THEIR LEGAL GUARDIAN HEREBY AFFIRMS THAT THE NAMED PARTICIPANT IS IN GOOD PHYSICAL CONDITION AND DOES NOT SUFFER FROM ANY DISABILITY, ILLNESS, OR OTHER CONDITION WHICH WOULD PREVENT OR LIMIT PARTICIPATION IN ATX MARTIAL ARTS AND TAEKWONDO KIDS.
    3. THE NAMED PARTICIPANT OR THE LEGAL GUARDIAN OF THE NAMED PARTICIPANT HEREBY AGREES that any pictures, audio, or visual recordings taken of him/her in connection with ATX MARTIAL ARTS AND TAEKWONDO KIDS can be used for publication, promotion, articles, shows, and advertisement without additional consent and without compensation at this time or any other time.
    THE NAMED PARTICIPANT, AND/OR THEIR LEGAL GUARDIAN HAS READ AND VOLUNTARILY SIGNED THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements or inducements apart from the foregoing written agreement have been made.  By voluntarily affixing my signature below, I warrant that I have read the entire Agreement and understand all of the foregoing: IN SIGNING THIS DOCUMENT, I FULLY RECOGNIZE THAT IF ANYONE IS HURT OR PROPERTY IS DAMAGED WHILE I OR MY CHARGE AM PARTICIPATING IN ATX MARTIAL ARTS AND TAEKWONDO KIDS EVENTS, I/WE WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST ATX MARTIAL ARTS AND TAEKWONDO KIDS, ITS OFFICERS, INSTRUCTORS, AGENTS, AFFILIATES, OR EMPLOYEES EVEN IF THEY OR ANY OF THEM NEGLIGENTLY CAUSED THE BODILY INJURY OR PROPERTY DAMAGE.  THIS AGREEMENT IS SIGNED AND DELIVERED TO INDUCE RELEASEES TO ALLOW PARTICIPATION IN ACTIVITIES BY PARTICIPANT.

Tony and I are so happy for Aidan! And we’re so incredibly proud of him. He has worked very hard and the hard work has paid off. He’s earned his Black Belt……an awesome accomplishment for him, or any other child for that matter.
It’s been a joy watching Aidan learn and grow in his confidence, skills and knowledge. And to witness Aidan demonstrate the tenets of Taekwondo in his daily life, now that’s a plus! In this day and age it’s hard enough for parents to instill the principles and values you want your children to live by. Having a team at the TKD school that supports and teaches valuable principles helps tremendously.
Aidan is here today accepting his black belt because of his perseverance. Perseverance, one of the most profound tenets of TKD in my opinion, is essential to succeed in anything you do in life that really matters to you. It means determination, persistence, never giving up.
Aidan didn’t give up…… and so here he stands today. It wasn’t easy though. There were some days when Aidan didn’t want to come to class - he was tired, was feeling unmotivated or would rather be doing something else on a particular day. Other day’s Tony and I had work schedule conflicts or WE ourselves were too tired to bring Aidan to class. We ALMOST quit once or twice because of these challenges. I think it would be safe to say that most of you have experienced what I just described, at one time or another. Don’t get discouraged, there’s hope. We’ve come to learn that it’s a normal part of the process, but it passes (as it did in our case and for many other families we’ve talked to). Thank God for giving us the hope and encouragement we needed to keep going.
Last but not least, we want to take the time to thank Mr. Johnson and his team of instructors for the countless hours and energy they put into the program for our children. Thank you for all you do…….every single one of you. We need more people like you in this world to be mentors for our children.

Mr. Johnson,
I wanted to let you know how much my wife and I appreciate Mr. Davis' help after class this past Saturday.
As you may know our oldest son Alan has been having problems breaking his green board. Before class Saturday I asked Mr. Davis if it would be possible to have Alan attempt to break the orange board, which he has done successfully in the past, as a confidence booster. He said that would be no problem. (I should also point out I spoke to Ms. English about this approach after Friday night's class and she felt like it would be no problem to try this approach.) True to his word, as class ended, he took Alan aside and worked with him for about 10 minutes. Not only did he have him break his orange board, he focused on Alan's technique and identified a couple of areas Alan needed to work on, e.g., keeping his eyes on the target & relaxing his arm. During that time Alan not only broke the orange board, but was able to break the green board with both of his techniques.
I'm sure this approach...breaking a previous board to boost one's confidence...is not a novel one, but it was great to hear from two of your staff their willingness to accommodate such a request and to see it in-play. Time and time again your staff as shown how much they do care about the kids and their success.
